Welcome to RA FITNESS! We're excited to have you on your fitness journey with us. Please read our terms and conditions below so you're informed and empowered as a valued member. This agreement outlines the terms of your membership with RAM ALBERT FITNESS INCORPORATED, doing business as RA FITNESS (“RA FITNESS”, “we”, “us”, or “our”).

By signing up digitally, you agree to become a member of RA FITNESS and confirm that this digital registration shall serve as your legally binding electronic contract, in accordance with the E-Commerce Act of the Philippines (RA 8792). In consideration of being allowed to participate in physical fitness activities and to use the facilities and equipment at RA Fitness, I hereby acknowledge and agree to the following:

1. GYM ACCESS. THE FEES PAID FOR MEMBERSHIP FEE, JOINING FEE, AND DOOR ACCESS ARE STRICTLY NON-REFUNDABLE AND NON-TRANSFERRABLE. The Door Access Key must be presented every time you enter the gym.

2. MEMBERSHIP FREEZE POLICY. RA Fitness implements a No-Freeze Policy given the discounted rates of gym membership. However, in extenuating circumstances, freezing may be allowed, subject to the approval and sole discretion of management.

3. GUESTS. Members may bring up to three (3) individual guests for a free trial once per month. Each guest must present a valid ID and sign a guest form before using the facility. Guest access is allowed only during office hours. BRINGING A GUEST OUTSIDE OF GUEST HOURS WILL INCUR A PENALTY OF PHP 500 PER VISIT. The member who brought the guest or gave access to the gym shall be liable for the penalty, and the member shall automatically allow the Management to bill them for the outstanding balance and/or recover the said balance legally. Each guest is limited to one visit per month per member. This policy ensures a fair experience for all members and prevents misuse of guest privileges. Members are welcome to officially enroll their guests anytime after their free trial!

4. ACCESS TO OTHER RA FITNESS GYMS. You will have access to other (if applicable) RA FITNESS GYMs when your membership starts. Gym membership shall be automatically transferred to this other branch if used for over a certain number of times. At the sole discretion of management, this shall be changed anytime depending on usage, and fees associated with the other branch may automatically change, which will be on the basis of the other branch's standard pricing.

5. AUTO-DEBITTING AND PENALTIES. YOU EXPLICITLY AGREE THAT MONTHLY DIRECT DEBIT/CREDIT CARD AUTO PAY OF YOUR MEMBERSHIP SHALL HAPPEN EVERY BILLING DATE. (If applicable) The charge for recurring payment will be processed at 12:00 AM for every billing cycle. Monthly dues are based on the member’s start date (e.g., if you joined on September 26, your due date is the 26th of each month). The system will retry and send reminders for three (3) times within three (3) days. You will be notified via your registered email for failed card payment methods. A PHP 300 PENALTY FEE APPLIES ONCE PAYMENT IS OVERDUE. AN ADDITIONAL PHP 300 WILL BE ADDED EVERY 5 DAYS UNTIL PAID. If all efforts to notify you on your registered email and/or mobile number of your unpaid dues are exhausted, RA Fitness reserves the right to report your account to the Credit Information Corp (CIC) Bureau, the national Credit Registry. This may affect your credit standing and future financial transactions. This is a last resort after multiple failed attempts to resolve your account amicably.

6. HEALTH DECLARATION. YOU AFFIRM THAT YOU ARE PHYSICALLY FIT TO ENGAGE IN STRENUOUS PHYSICAL ACTIVITY AND HAVE DISCLOSED ANY UNDERLYING MEDICAL CONDITIONS. YOU UNDERSTAND THAT RA FITNESS IS NOT LIABLE FOR ANY INJURIES RESULTING FROM THE IMPROPER USE OF EQUIPMENT OR NON-COMPLIANCE WITH INSTRUCTIONS.

7. GYM RULES & CODE OF CONDUCT. Members must wear appropriate attire and footwear, bring a towel, and sanitize equipment after use. Members must avoid unruly behavior, including loud arguments, disrespect, or damaging property. Members may not bring outside coaches, photographers, or videographers without approval. VIOLATION OF THESE RULES MAY LEAD TO IMMEDIATE SUSPENSION OR TERMINATION OF MEMBERSHIP WITHOUT REFUND.

8. CONTRACT RENEWAL, REFUND & CANCELLATION POLICY. MEMBERSHIP AND JOINING FEES ARE STRICTLY NON-REFUNDABLE. A PHP 5,000 CANCELLATION FEE APPLIES TO EARLY TERMINATION OF ANY ACTIVE CONTRACT PLUS THE CURRENT BILLING DURATION. If the contract is breached or terms are not fulfilled, the member will be required to pay the cancellation fee. Cancellation of existing promos shall be computed pro-rated based on the regular fees.

9. GYM ETHICS. YOU SHALL NOT ENGAGE IN ANY TYPE OF COMMERCIAL OR BUSINESS ACTIVITY WHILE USING THE FACILITIES. THIS INCLUDES ACTING AS A PERSONAL TRAINER WITHOUT AUTHORIZATION, INCLUDING PROVIDING FREE PERSONAL TRAINING TO OTHER MEMBERS. THIS IS GROUNDS FOR THE IMMEDIATE CANCELLATION OF YOUR MEMBERSHIP, WITH ALL OUTSTANDING BALANCES BECOMING IMMEDIATELY DEMANDABLE IN FULL.

10. LIABILITY WAIVER. YOU UNDERSTAND AND AGREE THAT RA FITNESS IS NOT RESPONSIBLE FOR PERSONAL BELONGINGS LOST OR DAMAGED IN THE FACILITY. YOU WAIVE ALL LEGAL CLAIMS AGAINST RA FITNESS, ITS STAFF, AND OWNERS IN THE EVENT OF INJURY, UNLESS DUE TO GROSS NEGLIGENCE.

11. PRIVACY, DATA USE, BIOMETRICS AND MEDIA CONTENT. RA Fitness abides by the Data Privacy Act of 2012 (RA 10173). Your personal information will be used solely for membership, gym management, and marketing communications from RA FITNESS. It will not be shared with third parties without your consent. FURTHERMORE, YOU EXPLICITLY CONSENT TO THE COLLECTION, CAPTURE, AND STORAGE OF YOUR FACIAL RECOGNITION AND/OR BIOMETRIC DATA FOR THE PURPOSES OF GYM ACCESS, SECURITY, AND IDENTITY VERIFICATION. BY SIGNING THIS AGREEMENT, YOU CONSENT TO BEING PHOTOGRAPHED OR RECORDED WHILE INSIDE RA FITNESS PREMISES. You allow RA FITNESS to use these photos/videos for marketing, promotional, or educational purposes including, but not limited to, social media, website content, print materials, and in-gym displays. All media content captured within the facility is considered the property of RA FITNESS and may be edited, published, and distributed at the sole discretion of management. You waive any right to inspect or approve the final materials wherein your likeness appears. You agree that no compensation or royalties will be given for the use of said media content, now or in the future. However, if you wish to opt out of photo/video inclusion, please notify the front desk or email us via owner@rafitness.net. We will make reasonable efforts to respect your request and to avoid publishing media that may cause undue embarrassment or breach personal privacy.

12. PAYMENT PROCESSING VIA XENDIT / TERMINAL. YOU ACKNOWLEDGE AND AGREE THAT ALL CREDIT CARD AND DEBIT CARD PAYMENTS, AS WELL AS RECURRING AUTO-DEBIT TRANSACTIONS, WILL BE SECURELY PROCESSED THROUGH XENDIT PHILIPPINES / TERMINAL, A BANGKO SENTRAL NG PILIPINAS (BSP) REGISTERED ENTITY. BY USING THESE PAYMENT METHODS, YOU AGREE TO BE BOUND BY THE APPLICABLE TERMS AND CONDITIONS OF XENDIT PHILIPPINES.

13. AUTHORIZED CHANGES AND PAYMENT. RA FITNESS WILL NOT HONOR ANY VERBAL AGREEMENT BETWEEN A MEMBER AND STAFF OR ANY AMENDMENTS TO THIS AGREEMENT AND TERMS AND CONDITIONS. ONLY THE TERMS AND CONDITIONS WRITTEN ON THIS AGREEMENT WILL APPLY. I understand that by continuing to use the services and the platforms of RA Fitness, it shall be the explicit acknowledgement of these terms and conditions and other terms written herein, and this shall waive the need for a physical signature.
